AUSTRALIAN VISA CHANGES: CONSOLIDATED RULES, ACCORDING TO THE EMBASSY

In order to ensure the sustainable growth of the international education sector in the country, the Australian government implemented a series of changes on July 1, 2016. The measures, according to the government, seek to facilitate the process for genuine students and carry out a filtering of schools and applicants that do not meet the standard desired by the country. They are expected to be in effect for the next 10 years for student visa applications to Australia.

According to the CEO of Globalvisa, Thiago Oliveira, the changes “significantly affect Indians who have chosen Australia as a destination for their studies. In addition to the requirement for English, which is something we saw in other countries and Australia did not adopt, there is an increase in available income for proof, which can bring some additional difficulties. At the same time, the opportunity for people who are able to prove access to annual income through their direct family members makes it very easy for those who fit this criterion”, concludes the director.

According to James, who coordinates the operations of the leading company in issuing and approving visas in India, “the Australian visa remains one of the best in the world, as it combines the possibility of long-term study, part-time work, the possibility of taking dependents and, if applicable and desired, migration to another type of temporary or permanent visa in the country. Even with the changes, Australia should still remain a priority destination for people, especially knowing that they can count on our team of experts to get their visas easily, quickly and safely”, concluded the CEO.

MAIN CHANGES:

1- The 8 subclasses no longer exist and now there are only two (Student 500 and Guardian 590), and people who are already in Australia will be able to migrate to the new subclass in the next renewal.

2- All protocols will be carried out online (although they are still mostly evaluated by the team at the Embassy in Brasília, where the Head Office of Globalvisa is located).

3- New risk assessment method to assess the need for proof of income or English level for the visa. The lower the risk level, the less proof will be needed. Crossing the country risk with the educational institution’s grade (neither will be public).

4- The better the school’s “score” with regard to immigration, the less visa requirements they will have in relation to documents proving income and English level.

5- Increase in the amount needed for proof of disposable income and new method of proof through access to annual income.

6- Possibility of migrating a visitor visa to a student visa.

7- Greater criteria in the evaluation of genuine courses, academic progression and correct age for the course.

CHANGES IN RELATION TO THE COURSE

Gradually Australia is taking steps to consolidate the education sector for foreigners as something of a very different level, just like the UK and some other countries. The changes in relation to the course are almost all aimed at improving the level of the course and the integrity of the students themselves. For Guardian Visa You can consult here

Institutions registered by Immigration:

Australian immigration is screening institutions that can host international students, based on course quality, transparency with immigration, and student behavior. Schools that are used by immigrants as a way to enter the country are being penalized, having their grades lowered and, eventually, even losing their registration to issue COE and enable a student visa.

Before contracting any course, it is worth checking with visa if it is on the list of courses and institutions registered by immigration and which, therefore, will be able to issue a valid COE for your course. It is important to be aware that some institutions are part of an educational group. In this case, they can still issue the COE, which will mention that the immigration registration name is different.

Course transfers during visa validity:

Course transfers without requesting a new visa will only be accepted when there is academic progression or maintenance at the same level as the previous course. The only exception is for doctoral cases that, changing the topic, can be transferred to a master’s degree. Transfers that do not meet this criterion will be considered a violation of the law and will result in the cancellation of the visa.

Anyone who wants, for whatever reason, to migrate to a lower level course, must apply for a new visa beforehand, knowing that immigration will take this very into account in the assessment.

Correct Age for High School

According to the government, “school age” in Australia starts at age 6 and must be completed before age 20. All High School students, regardless of nationality, will now need to meet the age criteria to enroll in the course.

CHANGES IN RELATION TO INCOME:

Proof of income has always been a villain in visa applications to Australia. Although this was even more complicated for those who need proof of income, as the values increased in relation to what they were before, new alternatives for proof of income were also offered, which perhaps meet the need of many students who wish to go to the country.

Who needs proof of income?

The immigration algorithm will determine whether or not you need proof of income to apply for a visa based on your country’s risk level and the grade of the educational institution you are going to. Globalvisa’s team of experts will inform you on a case-by-case basis whether or not this proof will be necessary. In any case, even people who are initially exempt from submitting proof of income documents may be required to submit documents at the request of the immigration officer evaluating the case.

Is it necessary to prove this value even though I can work in the country?

We have already dealt with this topic in other materials, but proof of income is indeed necessary for those who are going to work. The work permit in Australia, which is limited to 40 hours every two weeks (fortnight), is not intended to ensure your survival in the country, but rather to enhance your cultural experience and bring in supplementary income.

What are the accepted ways to prove income?

Although the amount to prove has increased, immigration has introduced a new form of proof which is through access to income. That is, you can prove sufficient disposable income (in a similar method to what existed before) or prove access to annual income. For those who need proof of income, it is necessary to choose one of these criteria:

– Sufficient funds to cover the course and 12 months of maintenance, in addition to the costs of travel, maintenance of dependents and school for dependents of school age (we will make specific material on this topic later).

– Evidence of access to annual income in excess of AUD 60,000.00. If you have more than one person in your family unit, proof from AUD 70,000 is required. In this case, documents from parents or spouses are accepted as support. The exchange rate for this calculation will be released semi-annually by immigration (July 1st and January 1st).
